MoneyPOP Terms of Use

Welcome to MoneyPOP, a financial empowerment platform designed for beauty entrepreneurs. These Terms of Use (“Terms,” “Agreement”) govern your access and use of the MoneyPOP mobile application, website, content, features, tools, and services (collectively, the “Service”).

By creating an account, using the Service, or subscribing to MoneyPOP Premium, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

Welcome to MoneyPOP! These Terms of Use (“Terms”) govern your access to and use of all MoneyPOP products, software, content, and features (collectively, the “Service”), including our website at www.moneypop.ai and our downloadable mobile applications on Apple's App Store and Google Play (together, the “Site”).

In these Terms, “MoneyPOP,” “we,” “us,” or “our” means MoneyPOP Inc. and “you” means the individual using the Service. If you use the Service on behalf of a business or organization, “you” also includes that entity.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

The Service may not be used where it would violate applicable law or subject MoneyPOP to regulatory requirements. If you access the Service outside the United States, you are responsible for compliance with local laws.

The Service is not designed to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA. If your use would be subject to such laws, you may not use the Service.

2. Description of the Service

MoneyPOP provides financial management tools designed primarily for beauty entrepreneurs, including:

Budgeting and cash flow planning
Predictive insights and spending analysis
Financial education and mindset tools
Goal setting and progress dashboards
Transaction import (manual or through third-party aggregation)

MoneyPOP provides information and educational resources only. Nothing in the Service constitutes legal, financial, tax, accounting, or investment advice.

3. Eligibility, Registration, and Account Security

3.1 Eligibility

To use the Service, you must:

Be at least 18 years old
Not have previously been suspended or removed
Comply with all applicable laws

3.2 Account Registration

You may be required to create an account. You agree to provide accurate and complete information and keep it updated.

3.3 Account Responsibility

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account

4. Subscriptions, Billing & Store Policies (Apple App Store & Google Play)

MoneyPOP offers free features, optional in-app purchases, and auto-renewing subscription plans.

4.1 Auto-Renewal Terms (Applies to Apple App Store & Google Play)

By purchasing a subscription through Apple or Google Play:

Your subscription automatically renews (monthly or annually) unless canceled at least 24 hours before the end of the billing cycle.
Your Apple ID or Google Play account will be charged for renewal at your plan's current rate.
Prices may vary by region and may be adjusted for taxes, exchange rates, or store-specific pricing rules.

4.2 Managing / Canceling Subscriptions

Because purchases are made through Apple or Google:

MoneyPOP cannot cancel or modify your subscription.
You must cancel or manage your plan through:

Apple App Store: Settings → Apple ID → Subscriptions
Google Play Store: Google Play → Profile Icon → Payments & Subscriptions → Subscriptions

Your cancellation becomes effective at the end of the current billing period.

4.3 Free Trials

If offered:

Your trial converts to a paid subscription unless canceled before it ends.
You will not be reminded when your trial is ending.

4.4 Refunds

Refunds are processed solely by Apple or Google Play based on their respective policies:

MoneyPOP cannot issue refunds for purchases made through app stores.

5. Permitted Use and Prohibited Activities

You agree not to:

Violate any laws or regulations
Exploit or harm minors
Upload harmful, fraudulent, abusive, defamatory, or illegal content
Send spam, promotions, or unsolicited messages
Interfere with or disable the Service
Use automated tools (bots, scrapers) without permission
Access or attempt to access accounts or systems without authorization
Upload viruses, malware, or malicious code

We reserve the right to determine whether conduct violates these Terms.

6. Privacy and Data Protection

By using the Service, you consent to our collection, use, and sharing of your information as described.

7. Financial Data, Third-Party Services & Links

7.1 Third-Party Financial Integrations

MoneyPOP may allow you to manually enter financial data or connect to third-party financial aggregators to import transaction data. You authorize MoneyPOP and its partners to process this data to provide the Service. MoneyPOP does not store your login credentials for external financial institutions.

7.2 Third-Party Services

MoneyPOP integrates with third parties. We do not control these services and are not responsible for their accuracy, policies, or performance. Your use of third-party services is governed by their own terms.

7.3 External Links

Links provided by the Service are for convenience only. MoneyPOP does not endorse and is not responsible for external websites or resources.

8. Intellectual Property & User Content

8.1 Ownership

All content, design elements, software, images, logos, branding, and text are owned by MoneyPOP Inc. or its licensors. You may not copy, distribute, modify, or create derivative works without written permission.

8.2 User Content

If you submit content (feedback, comments, non-financial data), you grant MoneyPOP a perpetual, royalty-free license to use it for improving the Service, consistent with our Privacy Policy. MoneyPOP is not responsible for user-submitted content.

9. Informational Use Only

MoneyPOP is not:

A financial advisor
An investment advisor
A CPA or tax advisor
A legal advisor

Information provided is for educational and informational purposes only, not professional advice. You are fully responsible for your business decisions.

10. Disclaimer of Warranties

To the fullest extent permitted by law:

The Service is provided “as is” and “as available.”
We do not guarantee error-free, uninterrupted, or secure service.
We do not guarantee the accuracy or reliability of any content or calculations.

MoneyPOP expressly disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law:

MoneyPOP and its officers, employees, directors, agents, and service providers are not liable for:

Indirect, special, incidental, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities

In no event will MoneyPOP's total liability exceed: (a) the amount you paid in the last 12 months, or (b) US $100 — whichever is greater.

Some jurisdictions do not allow certain exclusions, so some limitations may not apply to you.

12. Indemnification

You agree to defend and indemnify MoneyPOP against any claims, damages, losses, liabilities, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your content or your interactions with others

We may assume exclusive defense of such matters at our own discretion.

13. Modifications to the Service and Terms

We may update, modify, or discontinue parts of the Service at any time. We may revise these Terms with or without notice. Continued use of the Service indicates acceptance of updated Terms.

14. Termination

We may suspend or terminate your account or access to the Service at any time if we believe you violated these Terms. You may terminate your account by following the account deletion steps in the app or contacting hello@moneypop.ai. Provisions that reasonably should survive termination will continue.

15. Governing Law (U.S. / Florida Jurisdiction)

These Terms and any dispute related to the Service are governed by the laws of the State of Florida. Legal disputes must be brought exclusively in the state or federal courts located in Orange County, Florida, unless applicable law requires otherwise. You consent to jurisdiction and venue in those courts.

16. Entire Agreement; Waiver; Severability

These Terms and our Privacy Policy constitute the entire agreement between you and MoneyPOP. If any provision is found unenforceable, the remaining provisions remain in effect. No waiver of any term is a waiver of future enforcement.
